Effective / Last Updated: September 3, 2026
These Terms & Conditions govern your use of the Topgolf Swing Suite NJ website and, where applicable, your interactions with the venue. Specific reservation, promotion, event, payment, cancellation, or other terms presented at the time of purchase or contained in a signed agreement will apply in addition to these Terms and will control if there is a conflict.
1. Acceptance of These Terms
By accessing or using topgolfswingsuitenj.com (the “Website”), submitting an inquiry, making a reservation, purchasing or requesting services, or otherwise interacting with the Website, you agree to these Terms & Conditions (“Terms”) and our Privacy Policy. If you do not agree to these Terms, please do not use the Website.
For purposes of these Terms, “Topgolf Swing Suite NJ,” “Venue,” “we,” “us,” and “our” refer to the business operating the Topgolf Swing Suite venue located at 100 Schanck Road, Freehold, New Jersey 07728 and this Website. “You” and “your” refer to the Website visitor, customer, reservation holder, event organizer, or other person using the Website or Services.
2. Website Use and Eligibility
You may use the Website only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that information you provide through the Website is accurate, current, and complete.
Reservations, purchases, event inquiries, and other transactions should be made by an adult who is legally able to enter into the applicable transaction. Minors may use the Website only with appropriate parent or guardian involvement. Additional age restrictions may apply to particular activities, promotions, food and beverage service, or venue areas.
3. Reservations, Bay Rentals, and Availability
Bay rentals, gameplay, events, food and beverage offerings, promotions, hours, pricing, and other Venue services are subject to availability and may change from time to time.
A reservation is not guaranteed until it has been accepted or confirmed through the applicable booking process and any required payment, deposit, or other booking requirement has been satisfied. Reservation times may be subject to reasonable check-in, setup, transition, and operational requirements.
We may contact you using the information you provide to confirm, modify, administer, or otherwise communicate about a reservation, event, transaction, or service request.
4. Pricing, Payments, Taxes, and Fees
Prices and offers displayed on the Website are subject to change unless otherwise stated. Applicable taxes, service charges, booking fees, gratuities, deposits, or other charges may apply and will be disclosed when required or included in the applicable reservation, order, or event agreement.
Payments may be processed by third-party payment providers. We do not control the security or privacy practices of independent third-party payment services. Your use of those services may be subject to their separate terms and privacy notices.
You represent that you are authorized to use any payment method submitted in connection with a transaction and authorize the applicable charges associated with your purchase, reservation, or event.
5. Cancellations, Rescheduling, No-Shows, and Refunds
Cancellation, rescheduling, deposit, no-show, and refund terms may vary by reservation type, event, promotion, or service. The specific terms disclosed during booking, in a confirmation, on a promotional offer, or in an event or other written agreement apply to that transaction.
If a separate written agreement or booking confirmation contains cancellation or refund terms that differ from these general Terms, the more specific written terms will control. Unless a refund is required by law or provided under the applicable booking terms, amounts paid may be non-refundable.
We may need to modify, relocate, delay, or cancel reservations or services because of equipment issues, maintenance, safety concerns, staffing, weather, utility interruptions, government action, or other circumstances. When reasonably possible, we will communicate available options consistent with the applicable booking terms and law.
6. Events, Parties, and Group Bookings
Corporate events, celebrations, private parties, group outings, buyouts, and other organized events may be subject to a separate proposal, event agreement, banquet or food and beverage terms, deposit schedule, minimum spend, guest count, cancellation policy, or other written terms.
The person arranging an event is responsible for providing accurate event information and for communicating applicable Venue rules and event requirements to invited guests. If these Terms conflict with a signed event agreement, the signed event agreement will control with respect to that event.
7. Promotions and Special Offers
Promotions, discounts, contests, special offers, packages, and limited-time pricing may be subject to separate eligibility requirements, blackout dates, redemption periods, exclusions, quantity limits, or other restrictions. Unless otherwise stated, promotions cannot be combined and have no cash value.
We reserve the right to correct errors, reject fraudulent or abusive redemption, and modify or discontinue a promotion as permitted by law and the applicable offer terms. The terms displayed with a specific promotion control over these general Terms for that promotion.
8. Food and Beverage; Alcohol Service
Food and beverage offerings, menu items, pricing, service availability, and event packages may change without notice. Guests with allergies or dietary restrictions should inform Venue staff before ordering; however, we cannot guarantee an allergen-free environment.
Alcoholic beverages may be sold or served only to guests who are at least 21 years old and who provide acceptable identification when requested. We reserve the right to refuse or discontinue alcohol service when required by law or when Venue staff determine that service would be inappropriate or unsafe. Guests are expected to drink responsibly and arrange safe transportation.
9. Venue Conduct, Gameplay, and Safety
Topgolf Swing Suite gameplay and other Venue activities involve physical movement, sports equipment, simulator technology, and shared spaces. Guests must use equipment only as intended, remain aware of their surroundings, and follow posted rules and reasonable instructions from Venue staff.
You are responsible for choosing whether you are physically able to participate. Participation in recreational activities carries inherent risks, including the possibility of accidental injury or property damage. Nothing in these Terms waives or limits rights or liabilities that cannot lawfully be waived or limited.
We may refuse entry, discontinue gameplay or service, or remove a guest from the Venue for unsafe, disruptive, threatening, unlawful, intoxicated, abusive, or destructive behavior, or for failure to follow reasonable Venue rules. A guest may be responsible, to the extent permitted by law, for damage caused by intentional misconduct or negligent misuse of Venue property or equipment.
10. Prohibited Website Conduct
You may not use the Website to:
- Violate any applicable law, regulation, or third-party right.
- Submit false, misleading, fraudulent, defamatory, threatening, obscene, or unlawful material.
- Attempt to gain unauthorized access to the Website, servers, accounts, networks, or systems.
- Introduce malicious code, interfere with Website operation, or conduct automated scraping, crawling, data extraction, or security testing without authorization.
- Impersonate another person or misrepresent your identity, affiliation, reservation, payment authority, or eligibility for an offer.
- Use Website content or systems for unauthorized commercial purposes or in a manner that infringes intellectual property rights.
11. Intellectual Property and Brand Rights
The Website and its content, including text, graphics, photographs, video, layouts, software, icons, design elements, and other materials, are owned by or licensed to the Website operator and are protected by applicable intellectual property laws. Except as expressly permitted, you may not copy, reproduce, modify, distribute, publish, display, sell, license, create derivative works from, or commercially exploit Website content without permission from the applicable rights holder.
The Topgolf and Topgolf Swing Suite names, logos, marks, trade dress, technology references, and related brand assets are owned by their respective rights holders and are used under applicable authorization or license. Nothing on the Website grants you any ownership interest or license to use those marks except as expressly authorized in writing.
12. User Submissions, Reviews, and Communications
If you send us comments, feedback, reviews, photographs, ideas, or other materials, you represent that you have the right to provide them and that they do not violate the rights of others. We may use ordinary feedback and communications for customer service, business improvement, and other purposes consistent with our Privacy Policy and applicable law.
Any separate promotion, contest, social media, photo, video, or user-generated-content campaign may include additional submission and usage terms. Those specific terms will govern the applicable submission.
13. Third-Party Websites and Services
The Website may link to or integrate third-party services, including reservation tools, payment processors, maps, social media platforms, video services, analytics providers, and other external websites or applications. Third-party services are not controlled by us and are governed by their own terms and privacy practices.
A link or integration does not necessarily constitute an endorsement. We are not responsible for third-party content, availability, security, policies, or practices to the extent permitted by law.
14. Privacy
Our collection and use of personal information through the Website is described in our Privacy Policy. By using the Website, you acknowledge that you have had an opportunity to review the Privacy Policy.
15. Website Availability and Disclaimers
We work to keep the Website accurate and available, but we do not guarantee that Website content will always be complete, current, uninterrupted, error-free, or free from harmful components. Venue information, hours, pricing, course or game availability, menus, promotions, and other details may change, and inadvertent errors may occur.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. THIS DISCLAIMER DOES NOT LIMIT ANY WARRANTY OR RIGHT THAT CANNOT LAWFULLY BE DISCLAIMED.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE OPERATOR, VENUE, AND THEIR RESPECTIVE OWNERS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, REVENUE, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATING TO YOUR USE OF OR INABILITY TO USE THE WEBSITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Nothing in these Terms excludes or limits liability for fraud, willful misconduct, or any other liability that cannot be excluded or limited under applicable law. Any limitations applicable to a specific reservation, event, or transaction may also be set forth in the applicable written agreement.
17. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless the Website operator, Venue, and their respective owners, affiliates, licensors, service providers, employees, and agents from third-party claims, losses, liabilities, damages, judgments, costs, and reasonable expenses arising from your unlawful use of the Website, your material violation of these Terms, or content you submit that infringes the rights of another person. This provision does not require indemnification for claims caused by a protected party’s own conduct to the extent such indemnification is prohibited by law.
18. Changes to the Website and These Terms
We may update the Website, Services, and these Terms from time to time. When we revise these Terms, we will post the updated version on the Website and update the “Effective / Last Updated” date. Changes apply prospectively unless otherwise stated or required by law. Your continued use of the Website after updated Terms are posted constitutes acceptance of the revised Terms to the extent permitted by law.
19. Governing Law and Disputes
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-laws principles, except to the extent federal law applies. Subject to any different dispute-resolution terms contained in a specific signed agreement, any legal action relating to these Terms or the Website must be brought in a court of competent jurisdiction located in New Jersey, and the parties consent to the jurisdiction of those courts.
These Terms do not contain a mandatory arbitration agreement or class-action waiver. A separate event, reservation, or other signed agreement may contain additional dispute-resolution provisions that apply to that transaction.
20. Miscellaneous
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. Our failure to enforce a provision is not a waiver of our right to enforce it later.
These Terms, together with the Privacy Policy and any applicable booking confirmation, promotion terms, event agreement, or other written terms incorporated into a transaction, constitute the applicable agreement between you and us concerning the subject matter they address. Specific written transaction terms control over these general Website Terms if there is a conflict.
